A Pennsylvania man has been convicted of raping a 17-year-old girl who was intoxicated and unable to consent while the two were on a Susquehanna River island in July 2024, according to the Lancaster County District Attorney’s Office.
The victim had been drinking with friends along the river’s shoreline in Martic Township when 28-year-old Salvador Villa-Del Toro arrived on a jet ski and offered to take her for a ride, according to the District Attorney’s Office.
The 17-year-old later testified that Villa-Del Toro took her to an unidentified island on the Susquehanna River, where he raped her after getting her alone. She said she was in and out of consciousness and unable to consent to sex, according to the press release.
About an hour later, the girl returned with Villa-Del Toro, and her friends immediately noticed that something was wrong. She could barely stand or walk, according to the District Attorney’s Office.
Concerned that she may have been drugged, her friends called police to report a possible overdose, according to the release.
Troopers responded but were unable to speak with the girl because of her condition. She was instead taken to a local hospital, where a vaginal swab was collected, according to the District Attorney’s Office.
The swab matched Villa-Del Toro’s DNA, according to prosecutors.
Villa-Del Toro initially denied having sex with the girl. He later admitted to having a sexual encounter with her after dropping her off near a swimming hole, but described the encounter as consensual, the press release stated.
Prosecutors said Villa-Del Toro was aware that the girl was intoxicated at the time.
The case proceeded to trial, where Villa-Del Toro was found guilty on Sept. 24 following five days of testimony, according to the District Attorney’s Office.
